GENERAL TERMS AND CONDITIONS OF BUSINESS
Section 1 Scope of Applicability and Customer Information
The following General Terms and Conditions of Business regulate the contractual relationship between Mini Mundus Hobby GmbH (Mini Mundus) and consumers or companies that make purchases through our shop. Terms and conditions that contradict or differ from our terms and conditions of business will not be recognized by us. The language of the contract is German.
Section 2 Concluding a Contract
(1) The offers on the Internet constitute a non-binding invitation to you to purchase goods.
(2) You can add one or more products in the cart. During the ordering process, you enter your information and requests regarding payment, shipping methods. By entering your data and clicking on the order button, you submit a binding offer for the conclusion of a purchase contract. However, you can also submit a binding order by telephone or fax. The confirmation of the receipt of your order, sent immediately by e-mail or fax, does not yet constitute acceptance of the purchase offer.
(3) We have the right to accept your offer within three days by sending an order confirmation by e-mail. After the time limit specified in sentence 1 has lapsed ineffectively, your offer shall be deemed to have been refused, i.e. you will no longer be bound by your offer. In the case of a telephone order, the purchase contract comes into being if we accept your offer immediately. If the offer is not accepted immediately, you will no longer be bound by it.
Section 3 Customer Information - Storage of Your Order Data
Your order, containing details of the concluded contract (e.g. the type of product, price etc.), will be stored by us. We shall send these GTC to you. However, you can also access them via our website at any time after the conclusion of the contract.
As a registered customer, you can access your past orders via the customer login area (your account).
Section 4 Customer Information – Correction notice
You can correct your entered data, using the delete key, at any time before you submit your order. We will inform you of further possibilities to make corrections as you progress through the ordering process. You can terminate the ordering process at any time by closing the browser window.
Section 5 Retention of OwnershipThe object of the purchase shall remain our property until the purchase price has been paid in full.
Section 6 Time Limitation of Your Warranty Claims
(1) Liability for defects rights
There are statutory warranty rights for our goods.
(2) Warranty with respect to consumers for used goods
Your claims relating to defects with regard to used goods shall expire by time limitation one year after the handover of the sold item to you. Excluded from this provision are claims for compensation for damage, claims due to defects that we maliciously conceal and claims stemming from a guarantee that we have provided for the quality/characteristics of the goods. The statutory time limitation periods apply to those excluded claims.
(3) Warranty with respect to companies
Your warranty claims relating to defects in the purchased goods will expire by time limitation one year from the transfer of risk. Excluded from this provision are claims for compensation for damage, claims due to defects that we maliciously conceal and claims stemming from a guarantee that we have provided for the quality/characteristics of the goods. Also excluded is the right to recourse under Article 478 of the German Civil Code (Bürgerliches Gesetzbuch). The statutory time limitation periods apply to those excluded claims.
Section 7 Limitation of Liability
We accept no liability for breaches of obligation due to minor negligence unless they relate to key contractual obligations, damage resulting from loss of life, bodily injury or impaired health, or guarantees or claims under the German Product Liability Act (Produkthaftungsgesetz). The same applies to breaches of obligation by our vicarious agents or statutory representatives. Key contractual obligations include, in particular, the obligation to hand over the goods to you and provide you with the ownership title to them. We are also obliged to provide you with the goods free of any material or legal defects.
§ 9 Dispute Settlement
The European Commission provides a platform for online dispute resolution (OS) under the following link: http://ec.europa.eu/consumers/odr/ Consumers have the opportunity to use this platform for the settlement of their dispute.
If you are a trader, the exclusive place of jurisdiction for all disputes stemming from this contract is the location of our registered office.
